Terms of service

The owner of the online store Specler (hereinafter referred to as the "Online Store") is OÜ DBLE (registry code 14769690), located at Vae tn 2, Laagri alevik, 76401 Saue vald, Harju maakond, Estonia.

Validity of the Sales Contract, Product and Price Information

The terms and conditions apply to purchases made from the Online Store. The prices of products sold in the Online Store are indicated next to the respective products. All prices are final consumer prices and include value-added tax (24% VAT or 9% VAT in the case of optical glasses). A delivery fee may be added to the price of the goods. The delivery fee depends on the buyer’s location and the chosen delivery method. The delivery fee will be displayed to the buyer during the checkout process. Information about the products is provided directly next to the products in the Online Store. Product images are illustrative and may differ slightly from the actual product. Minor variations in color, shape, or details do not constitute non-conformity of the goods.

Placing an Order

To place an order, the customer must first select suitable frames and then choose lenses according to their prescription. The prescription details can be entered manually, uploaded as an image, or submitted later via email. The Online Store is not responsible if the prescription information provided by the customer is incorrect or does not match the customer’s actual vision needs. To complete the order, the required fields must be filled in and a suitable delivery method selected. The total amount to be paid will then be displayed on the screen, which can be securely paid using the following payment methods:

  • Bank payments via Estonian banks
  • Visa/Mastercard card payments
  • Apple Pay and Google Pay
  • Pay later solutions

NB! When paying via bank link, you must click the "Return to merchant" button on the bank’s page.

Payments are mediated by Maksekeskus AS. Payments take place outside the Online Store in a secure environment – when paying via bank link, in the secure environment of the respective bank, and when paying by credit card, in the secure environment of Maksekeskus AS. The seller has no access to the buyer’s bank or credit card details. The contract enters into force once the amount due has been received in the Online Store’s bank account.

The owner of the Online Store is the controller of personal data and forwards the personal data necessary for processing payments to the authorized processor Maksekeskus AS.

If it is not possible to deliver the ordered goods due to their depletion or for any other reason, the buyer will be informed at the earliest opportunity and the paid amount (including delivery costs) will be refunded immediately, but no later than within 14 days of sending the notice.

Delivery

Products are shipped to the following country: Estonia.

For receiving the goods, the buyer has the following options:

  • Omniva parcel machines
  • Smartpost parcel machines

The shipping costs are borne by the seller.

Domestic shipments within Estonia usually reach the buyer’s designated destination within 7 business days from the entry into force of the sales contract, except for certain glasses with custom-made lenses (progressive lenses, certain high-index lenses, and blue light protection lenses, optical sunglasses). In such cases, delivery takes 3 to 6 weeks, and the estimated delivery time will be displayed to the buyer before completing the purchase. The Online Store reserves the right to deliver goods within up to 30 calendar days from the conclusion of the contract.

The Online Store is not responsible for delays or delivery failures caused by circumstances beyond its reasonable control (force majeure), such as postal or courier strikes, supply chain disruptions, natural disasters, or similar events.

Right of Withdrawal

Pursuant to § 53 (4) of the Law of Obligations Act, the 14-day right of withdrawal does not apply to products that are custom-made (including optical devices manufactured according to the customer’s prescription).

The following products cannot be returned:

  • single-vision corrective lenses with thinning (marked in the Online Store as "premium" lenses);
  • progressive lenses, including sunglasses with progressive lenses.

Nevertheless, the Online Store offers the buyer the option to return the following products free of charge within 14 days:

  • non-prescription glasses, including sunglasses;
  • blue light protection glasses;
  • single-vision corrective standard lenses (marked in the Online Store as "standard" lenses, i.e. without thinning and without blue light protection), including single-vision corrective sunglasses.

For the above-mentioned products, the buyer has the right to withdraw from the contract concluded in the Online Store within 14 days after receiving the goods. The right of withdrawal does not apply if the buyer is a legal person.

To exercise the 14-day right of withdrawal, the product may only be used in a manner necessary to determine its nature, properties, and functioning, as would be permitted when testing the product in a physical store. If the product has been used for purposes other than those necessary to establish its nature, properties, and functioning, or if it bears signs of use or wear, the Online Store has the right to reduce the refundable amount according to the decrease in the value of the product.

To return a product, the buyer must submit a free-form written request to info@specler.ee no later than 14 days after receiving the goods. The buyer must return the goods within 14 days after submitting the withdrawal request or provide proof that the goods have been handed over to the carrier within the mentioned period.

Upon receipt of the returned goods, the Online Store will promptly, but no later than 14 days from the receipt of the withdrawal request, refund to the buyer all payments received under the contract. The Online Store may withhold the refund until it has received the goods subject to the contract or until the buyer has provided proof of having returned the goods, whichever occurs first.

If the buyer has explicitly chosen a delivery method other than the cheapest standard delivery method offered by the Online Store, the Online Store is not required to refund the cost exceeding the usual delivery cost.

The Online Store has the right to withdraw from the sales transaction and demand the return of the goods if the price of the goods in the Online Store has been mistakenly marked significantly below the market value of the goods.

Right to Submit a Claim

The Online Store is liable for any non-conformity of goods sold to the buyer or for defects that existed at the time of delivery of the goods and which appear within two years from the delivery of the goods to the buyer. Within the first year after delivery, it is presumed that the defect already existed at the time of delivery. The burden of proof to rebut this presumption lies with the Online Store.

The buyer must notify the Online Store of any defects within two months of their discovery by sending an email to info@specler.ee

The Online Store is not liable for defects that appear after the goods have been delivered to the buyer.

If the product purchased from the Online Store has a defect for which the Online Store is responsible, the Online Store will repair or replace the defective product. If the product cannot be repaired or replaced, the Online Store will refund the buyer all payments received under the sales contract.

The Online Store will respond to the consumer’s complaint in writing or in a form that can be reproduced in writing within 15 days.

Direct Marketing and Processing of Personal Data

The Online Store uses the personal data entered by the buyer solely for processing the order and delivering the goods to the buyer. The Online Store forwards personal data to the transport service provider for the purpose of delivering the goods.

The Online Store sends newsletters and offers to the buyer’s email address only if the buyer has expressed a wish to receive them by entering their email address on the website and indicating consent to direct marketing messages.

The buyer can unsubscribe from offers and newsletters sent to their email address at any time by notifying the Online Store via email or by following the instructions provided in the marketing emails.

In addition, the Online Store may use cookies and similar technologies to ensure the proper functioning of the website, enable convenient user experience, and analyze website traffic. Details of cookie usage and data protection practices are described in the Privacy Policy available on the Online Store website.

Intellectual Property

All content on the Online Store website, including texts, product descriptions, images, logos, and design elements, are the intellectual property of OÜ DBLE or its partners. They may not be copied, reproduced, distributed, or used for commercial purposes without the prior written consent of OÜ DBLE.

Amendments to the Terms and Conditions

The Online Store reserves the right to unilaterally amend these Terms and Conditions. The version of the Terms and Conditions applicable at the time of purchase will apply to each order. Updated Terms and Conditions will be published on the Online Store website.

Dispute Resolution

If the buyer has any complaints regarding the Online Store, they must be submitted via email to info@specler.ee

If the buyer and the Online Store are unable to resolve the dispute through mutual agreement, the buyer may contact the Consumer Disputes Committee. The terms of the procedure can be reviewed, and an application can be submitted here. The Consumer Disputes Committee is authorized to resolve disputes arising from contracts concluded between the buyer and the Online Store. The review of the buyer’s complaint by the committee is free of charge.

The buyer may also turn to the European Union’s Online Dispute Resolution (ODR) platform.
